1. Acceptance of Terms

By using Optimum Web services or this website, you agree to these Terms and Conditions. If you do not agree with any part of these terms, do not use our services or website.

2. Service Descriptions

Services are described on individual service pages on our website. We reserve the right to modify or discontinue services with 30 days written notice to affected clients. Service descriptions on the website represent the current offering at the time of viewing.

3. Client Obligations

When engaging Optimum Web for services, clients agree to:

  • Provide accurate and complete project information
  • Respond to communication within agreed timeframes
  • Provide required access (server, repository, credentials, etc.) within 48 hours of request
  • Pay invoices within agreed payment terms

4. Intellectual Property

Intellectual property rights are handled as follows:

  • Code delivered as part of a project is owned by the client upon full payment
  • Optimum Web retains the right to reference the project in our portfolio (unless an NDA prevents this)
  • Third-party libraries and open-source components included in deliverables are subject to their own respective licenses

5. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties without written consent. We sign Non-Disclosure Agreements (NDAs) on request before discussing any project details.

6. Limitation of Liability

Optimum Web's maximum liability for any claim arising from our services is limited to the amount paid by the client for the specific service in question. We are not liable for indirect, consequential, incidental, or punitive damages arising from the use of our services.

7. Warranty

Our warranty terms are as follows:

  • Fixed Price Services carry a 14-day warranty for the specific delivered scope
  • Custom development projects carry a 30-day bug warranty for issues within the delivered scope
  • Warranty does not cover issues caused by client modifications, third-party services, or changes to the operating environment after delivery

8. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Moldova. Any disputes arising from these terms shall be resolved in the courts of Chisinau, Moldova, unless otherwise agreed in writing by both parties.

9. Modifications

We may update these Terms and Conditions from time to time. Continued use of our services after changes are published constitutes acceptance of the updated terms. We notify active clients of material changes by email at least 14 days before they take effect.
